Terms of Service

These terms govern bookings, payments, cancellations, revisions, licensing, file delivery, and general responsibilities when working with 115creative.

By booking services with 115creative, the client agrees to these Terms of Service.

Specific deliverables, timelines, and pricing may be outlined further in invoices, booking confirmations, or written agreements, but the terms below apply to the general working relationship.

1. Services

115creative provides podcast production, video production, photography, editing, and related media services. Specific deliverables, timelines, and pricing will be outlined in individual invoices, booking confirmations, or written agreements.

2. Booking & Payment

Full payment is required to reserve and confirm your booking. In certain circumstances, payment arrangements may be discussed in advance, but must be agreed to in writing. Bookings are not secured until payment has been received.

3. Cancellations & Rescheduling

Cancellations made with at least 72 hours’ notice are eligible for a full refund. Clients may request one free reschedule with at least 24 hours’ notice, subject to availability. Additional rescheduling requests may incur fees. Same-day cancellations or cancellations with less than 24 hours’ notice are non-refundable. Refunds are subject to processing fees.

4. Scope of Work & Add-Ons

Services are limited to what is outlined in your invoice or booking confirmation. Any additional services or add-ons must be requested in advance and are subject to availability. Last-minute requests are not guaranteed and may not be accommodated.

5. Editing & Revisions

Editing services include one round of revisions, intended for up to approximately 1 hour of edit time. Additional revisions or more complex changes may require extra time and will be billed accordingly. Clients are encouraged to clearly communicate expectations, references, and style preferences before editing begins.

6. Turnaround Times

RAW photo and video files, if included or requested, are typically delivered within 24 hours. Editing turnaround times vary depending on the scope of the project, but are generally 1 to 5 business days. Timelines are estimates and may vary based on workload and project complexity.

7. Studio Time & Overtime

Overtime, if available, will be billed at the standard hourly rate. Overtime is not guaranteed and depends on availability. Clients are encouraged to book sufficient time in advance or reach out for recommendations based on their production needs.

8. Studio & Equipment Responsibility

Clients are responsible for any damage caused to the studio, equipment, or gear during their session or shoot. This includes full replacement cost for broken items and repair or replacement costs for damaged equipment.

9. Client Responsibilities

Clients are responsible for arriving on time. Late arrival will not extend the session time. It is recommended to arrive early and be ready to begin at the scheduled start time. Clients are responsible for ensuring all participants are prepared and that any required assets such as logos, wardrobe, props, or references are provided.

10. Photo & Video Usage License

Upon full payment, 115creative grants the client a non-exclusive license to use the final delivered photos and videos for their intended purposes. This license does not transfer copyright ownership unless explicitly agreed to in writing. Clients may not resell, sublicense, or distribute the content for third-party commercial use without written permission. 115creative retains full copyright ownership of all content created.

11. Portfolio & Promotional Use

115creative retains the right to use all produced content for portfolio, marketing, and promotional purposes. If a client requires content to remain private or unused for promotional purposes, this must be agreed to in writing in advance and may be subject to an additional fee.

12. RAW Files & File Delivery

RAW photo and video files are available upon request for projects that include editing, at no additional charge. Delivered files will be shared via Dropbox or a similar platform. Clients have 7 days to download and back up all delivered files. 115creative does not guarantee file availability beyond 7 days and is not responsible for lost files after this period.

13. Limitation of Liability

115creative is not liable for missed content due to timing, client direction, circumstances beyond control, or technical issues outside of reasonable control. Total liability, if applicable, is limited to the amount paid for the service.

14. Right to Refuse Service

115creative reserves the right to refuse service at its discretion.

15. Minimum Booking

A minimum booking of 1 hour is required for all sessions unless otherwise agreed.

16. Agreement

By booking services with 115creative, the client agrees to these Terms of Service.
